This document defines the terms and conditions under which FED SOLUTION S.R.L. offers users access to the services provided through the portal https://decretoflussiitalia.it/.

1. INTRODUCTION

Welcome to Decretoflussiitalia.it. These General Conditions govern the purchase and use of the services offered on our website, including both subscriptions and consulting services.

The use of the portal for the purchase of these services implies the full and unreserved acceptance of the terms and conditions indicated herein. We therefore encourage users to read this document carefully before proceeding with any purchase transaction.

The following provisions provide detailed information on the types of services available, on the methods of disbursement, the accepted payment methods, the renewal and cancellation procedures, as well as the mutual rights and obligations of the contracting parties.

It is emphasized that the acceptance of these Terms and Conditions constitutes an essential requirement for access to and use of the platform services. Users are therefore encouraged to read this document carefully before proceeding with any transaction or request to activate the services.

2. DEFINITIONS

  • MANAGER: FED SOLUTION S.R.L., a single-member company with registered office in Viale Giovanni Bovio n. 48, Cesena (FC), CAP 47521, C.F. and P. VAT 04759000401, paid-up share capital €10.000,00, which can be contacted by e-mail at fedsolutionsrl@gmail.com.
  • SITE or PORTAL: The portal Decretoflussiitalia.it, accessible at decretoflussiitalia.it.
  • USER: Any person (natural or legal person, worker, employer, company) who has successfully completed the registration procedure to the Portal.
  • GENERAL CONDITIONS or CGC: This document, entitled “General Conditions of Contract and Terms of Use of the Services”, which the USER fully accepts at the time of registration and which applies to all the services currently available on the Portal, as well as those that may be implemented in the future.
  • USER OF THE SITE: Subject that is limited to the consultation and navigation of the Site, without completing the registration procedure.

3. OBJECT

These General Conditions of Contract (GTC) set out the terms, conditions and manner in which the MANAGER provides and manages the services offered to USERS through the Platform. This document constitutes the legal and operational basis for the use of the services, defining the mutual rights and responsibilities of the parties.

The interaction between the Platform and the USE OF THE SITE, limited to consultation and navigation, is instead governed exclusively by the Privacy Policy, available at the bottom of the main page of the Site. We invite each USER to consult this policy to understand how their personal data is processed.

These GTC do not govern the services or products offered by third parties accessible through links, banners or other connecting methods on our Site. The MANAGER does not exercise any control over such external content and disclaims any responsibility for services, products or content provided by third parties. The USER is recommended to read carefully the contractual conditions, sales policies and privacy policies of third parties before proceeding to transactions or the communication of personal data. This precaution is essential to ensure the protection of your rights and the security of your information.

4. ACCEPTANCE OF THE TERMS AND CONDITIONS AND DECLARATIONS OF THE USER

The acceptance of these General Terms and Conditions (GTC) and registration to the Platform constitute fundamental requirements for the access and purchase of the services offered.

The acceptance is formalized at the end of the registration procedure on the portal, by filling in a special form. The USER is required to provide accurate and complete information. The MANAGER does not assume the obligation to verify the veracity of the information provided, except for the Workers Users, for whom a preliminary verification by our staff is provided.

During the verification phase, the user’s account will be marked as “pending”. Upon completion of the verification successfully, the USER profile will be activated and made visible to the Employers Users on the Portal. In case of non-approval, the USER will receive a communication containing the reasons for non-approval and any actions necessary to correctly complete the registration.

5. CHANGES TO GENERAL CONTRACT CONDITIONS

These General Terms and Conditions (GTC) may be subject to regular updates.

The MANAGER reserves the right to modify and supplement the GTC and related specifications, if necessary.

Changes due to new laws or regulations, or which do not substantially affect the relationship between the parties, will come into force from the date of publication on the Site. In this case, the USER has the right to cancel the subscription at any time by accessing his reserved area, without prior notice or direct communication to the MANAGER. It should be noted that the cancellation will not involve any refund for services already used or purchased.

If the changes involve substantial changes, significantly affecting the relationship between the MANAGER and the USER, the latter will be informed by notice on the Site or by other appropriate means. In this case, the USER will have the right to cancel the subscription directly from their reserved area. Also in this circumstance there will be no refund for what has already been paid. The continuation in the use of the service after the date of entry into force of the changes will imply the tacit acceptance of the same by the USER.

6. REGISTRATION AT THE PORTAL “decretoflussiitalia.it”

Registration for the USER “Worker”
Registration to the portal for Workers Users is subject to the purchase of a subscription. Only after completing the purchase, the USER will be able to proceed with the compilation of his profile, which will become visible only in part to the Users of Workers who visit the portal and in full (complete contact data) to the Employers registered on the portal. During registration, the USER must provide essential personal information, such as name, surname, e-mail address and telephone number, as well as any other data necessary for the creation of the profile. It is recommended to consult the privacy policy for detailed information on the nature of the data collected and how to process it.

The access data, including the e-mail address and password, are strictly confidential, and the USER is responsible for their security.

The USER acknowledges that the e-mail address and password provided constitute the authentication elements for access to the platform.
Registration is subject to prior verification of the data provided by the staff. After registration, the USER’s account will be marked as “pending” until the verification process is completed. Only after confirmation of the veracity of the data will the USER be enabled and made visible to the Users of Work. In case of non-approval, the USER will receive a communication containing the reasons for the refusal and any corrective actions to be taken to complete the registration.

Registration for the USER “Employer”
The USER Employer can browse the portal without registering, obtaining in this case access only to some basic information of the profiles of the workers, with the exclusion of contact data. To view the entire profile of the workers, including contact details, you must complete the free registration to the portal.

Registration requires the completion of a form containing the information necessary for the identification of the USER Employer, including the company name, the tax code, VAT number, e-mail address and other data relating to the company activity. It is recommended to consult the privacy policy to obtain detailed information on the type of data collected and how to process it.

In the future, additional advanced services and specific paid advice will be available, for which updated information will be provided at the time of their introduction.

Account Liability and Security
The USERS assume full responsibility for all the activities carried out through their access data and undertake to maintain the utmost confidentiality of their credentials and to promptly inform the MANAGER of the site in case of suspected unauthorized use of the same.

In case of violation of the security conditions or improper use of the credentials, users are required to immediately notify the site’s MANAGER.

Erasing or Modifying the Profile
The USER can request the cancellation of his account at any time by sending a request by e-mail to customer service.

If you wish, the USER also has the possibility to make his card unvisited, keeping his registration on the portal active. To this end, it is necessary to submit a written request using the Request and Support form, accessible within the reserved area.

7. SERVICES OFFERED BY THE PORTAL MANAGER

Services for Workers Users
Workers Users who purchase a subscription through the Decretoflussiitalia.it platform access a series of dedicated services. These include the creation of a personal profile, the visibility of the profile to employers who visit the portal and access to specific resources to facilitate job placement in Italy. The availability and type of services vary depending on the type of subscription chosen (monthly, quarterly and semi-annual).

The USER Worker can also opt for the “highlight” subscription service, which guarantees greater visibility of the profile through positioning in specific sections of the site, with an estimated impact up to 5 times higher than standard subscriptions. From its reserved area, the USER Lavorator has the right to update and modify their data at any time.

Services for Employers Users
The USER Employer can currently browse the portal without registering, having in this case access only to some basic information of the profiles, with the exclusion of the contact details of the workers. Alternatively, you can register for free, thus obtaining full access to the contact details of the workers.

Registration is also useful to facilitate access to future additional services, currently being implemented, such as personalized advice and other advanced features that will be made available later.

Activation of the Services
Unless otherwise agreed, the services purchased will be activated as soon as the MANAGER has received confirmation of payment. In case of technical difficulties or delays in activation, the USER is invited to contact the customer service for assistance.

8. PURCHASE METHODS OF THE SERVICES

Purchase of Subscriptions for Workers Users
The purchase of a subscription is mandatory for workers who wish to register and make their profile visible to employers who visit Decretoflussiitalia.it. Available subscriptions can have a variable duration (monthly, quarterly or semi-annual), with specific features and associated benefits. The selected subscription will be activated at the time of payment confirmation.

Every subscription you purchase requires automatic renewal. The USER can manage the status of their subscription through the reserved area and will receive notifications regarding renewal. Within your reserved area there is a practical guide that it is recommended to consult to deactivate the subscription, if desired.

Payment Options
The payment of subscriptions can be made through the methods active at the time of subscription, such as credit/debit card (stripe), PayPal, bank transfer or other options indicated on the site.

For payments made by bank transfer, the USER is required to send the confirmation of the transfer within 5 days of the order, in order to avoid delays in the activation of the service.

Upon receipt of payment, a regular invoice will be issued and sent to the e-mail address provided by the USER via the contact form.

Renewal and Cancellation of Subscriptions
Subscriptions provide for automatic renewal at the deadline. Users are responsible for monitoring the status of their subscription and, if they wish to interrupt the renewal, they must proceed independently to the cancellation or modification through their reserved area, following the instructions available.

The MANAGER does not assume the responsibility of personally notifying the USER in case of non-renewal due to inattention, except for automatic notifications or reminders sent by e-mail. In case of cancellation, the subscription will remain active until the end of the period already paid; there is no refund for the unused period.

It should be noted that any charges subsequent to the cancellation, deriving from third parties (such as PayPal), are the sole responsibility of the same intermediaries. FED SOLUTION S.R.L. disclaims any responsibility for failure to deactivate the subscription by these payment service providers.

Resolution of the Contract
In case of cancellation or failure to make a payment made by credit card, PayPal, or other electronic payment methods, the MANAGER reserves the right to immediately deactivate the service and to consider the contract terminated without notice. The USER will be informed of the cancellation of the payment and, if you wish to continue to use the service, will be required to regularize the situation with a new payment.

In case of payment by bank transfer, if the payment is not credited within the established deadlines, the MANAGER reserves the right to cancel the procedure for activating the service and to consider the contract terminated without notice. The USER will be informed of the non-receipt of the payment and, if he intends to activate the service, he will have to provide for the timely fulfillment of the payment obligation.

9. USER PERSONAL SHEET

The User’s Personal Card is a service that is automatically activated upon completion of registration on the Portal, subject to the completion of the subscription. The Person Card allows the worker to create a detailed profile with personal and professional information, visible to employers who visit the portal.

The compilation of the Personal Data Sheet is under the sole responsibility of the USER, who is required to provide accurate, up-to-date and truthful information. The MANAGER does not assume the obligation to verify the veracity of the information provided, except for the Workers Users, for whom a preliminary verification by our staff is provided. The USER can modify the data of his card at any time and independently through access to his Reserved Area.

During the verification phase, the user’s account will be marked as “pending”. Upon completion of the verification successfully, the USER profile will be activated and made visible to the Employers Users on the Portal. In case of non-approval, the USER will receive a communication containing the reasons for non-approval and any actions necessary to correctly complete the registration.

Once completed and approved by the staff, the Staff Card will be made visible to employers who access the portal. The methods of publication and the order of display of the cards are determined exclusively by the MANAGER of the platform, except for the “highlight” tabs that will have priority visibility. If the USER wishes to make his/her card unavailable while keeping the registration on the portal active, he can submit a written request using the Request and Support form available in the account settings section within his Reserved Area.

The Personal Card remains editable at any time by accessing the account settings.

Creation of the Personal Board for Employer Users
Employers registered on the portal can create a Staff Form that will be made visible to registered workers. This form will contain essential information about the company, such as company name, sector of activity, address of the registered office, main contacts and other relevant information. The creation of the card is free and not bound to purchase services.

Additional Services for Visibility
The MANAGER reserves the right to offer, through additional paid services, greater visibility and better indexing of personal data sheets, both for workers and for employers. These services will be described in detail on the site and will be made available for purchase by interested users.

Inappropriate or False Content
The MANAGER reserves the right to refuse the publication or to remove the contents of the Personal Data Sheets that do not comply with the requirements of truthfulness and correctness. The MANAGER may also suspend or delete, in its sole discretion, profiles that contain false or inappropriate information.

10. RESPONSIBILITY OF THE MANAGER

Operation of the Portal
The MANAGER undertakes to ensure the smooth and continuous operation of the Decretoflussiitalia.it platform, adopting all the necessary technical measures to maintain the active and operational services. However, the MANAGER does not guarantee that access to the portal will be uninterrupted or error-free, and declines any responsibility for any temporary interruptions due to technical maintenance, updates or force majeure.

Limitation of Liability
The MANAGER cannot be held responsible for any direct, indirect, incidental or consequential damages resulting from the use or inability to use the services offered by the platform. This exclusion includes, but is not limited to, loss of data, loss of profits, interruption of business or any other economic loss arising from, or related to the use of the Portal.

The MANAGER also declines any responsibility for any damage resulting from the improper or fraudulent use of access data by Users, as well as for any unauthorized use of the personal profile by third parties. The USER is obliged to guarantee the security of their login credentials and to promptly inform the MANAGER in case of suspected unauthorized use. All liability for the protection and confidentiality of your access data falls exclusively on the USER.

In no case does the MANAGER guarantee the success of the meeting or contact between employers and workers enrolled in the platform, nor does it assume any responsibility for lack of contacts, assumptions or collaborations between the parties. The service provided by the Portal is limited to the provision of a space for the visibility of the profiles of the USERS and does not provide any guarantee of result in the interactions.

Technical Responsibilities
The MANAGER adopts advanced and commonly accepted technologies in the industry to ensure the security and protection of user data. However, it cannot be held responsible for any technical malfunctions or for the non-compatibility of the portal with the technologies used by the USER. Any claim relating to technical malfunctions will be limited to the amount of the type of fee paid by the USER.

Interruption of the Service
In case of complete interruption of the service for a period of more than 30 consecutive days, the USER will have the right to terminate the contract, with the right to a proportional refund for the period of service not used. In the event of malfunctions or technical problems, the USER is required to contact the MANAGER promptly to allow the problem to be resolved.

Exclusion of Other Liability
The MANAGER will not be liable for any loss of revenues, profits or data suffered by the USER, nor for damages resulting from interruptions, suspensions, delays or malfunctions of the service, if they are caused by circumstances beyond the will of the MANAGER, including force majeure events or actions of third parties.

11. APPLICABLE LAW AND JURISDICTION

For any dispute arising from the interpretation, execution or termination of this contract, exclusive jurisdiction is attributed to the Court of Forlì-Cesena, unless otherwise provided for legislation.

If the USER is qualified as a consumer under the Consumer Code, the territorial jurisdiction will be established in accordance with the provisions for consumer protection, thus guaranteeing the possibility of resorting to the court of residence or domicile of the consumer, if located in Italy.

13. PRIVACY AND DATA PROTECTION

The processing of personal data collected during the subscription process and during the use of the services is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and the Italian legislation applicable in the field of personal data protection. Users accept that their personal data are processed in a lawful, correct and transparent manner, exclusively for the purposes related to the provision of the platform services and in compliance with the principles of minimization, integrity and confidentiality.

The complete information on the processing of personal data, including the rights of users and the methods of exercising these rights (access, rectification, cancellation, limitation, portability and opposition), is available in the section “Privacy Policy” of the site. We encourage all users to consult this policy carefully before using the services of the Portal.

14. DECLARATIONS OF THE USER

In accordance with and for the effects of art. 1341 and 1342 c.c., as well as of articles 33, 34, 35 and 36 of the D.Lgs. 206/2005 (Consumer Code), the USER of the site declares to have read, understood and expressly approved the following articles of the General Conditions of Contract and Terms of Use of the Services: Subject of the contract (Article 3), Acceptance of the Terms and Conditions and Declarations of the USER (Article 4), Registration at the Portal “decretoflussiitalia” (Article 6), Services offered by the MANUnder of the Portal.10), Applicable Law and Jurisdiction (Article 11), and Changes to the General Conditions of Contract (Article 5).
In particular, the USER declares to specifically approve the clauses indicated above, including those of a vexing nature, in accordance with articles 1341 and 1342 of the Italian, confirming his explicit acceptance.
